On 22 January 2025, Jared Kushner announced plans to construct a “New Gaza”, presented as reconstruction but in reality a speculative real-estate project imposed on a population subjected to mass killing, forced displacement, and total infrastructural destruction. This proposal is being advanced while Israel has been deemed to have committed genocide by the UN commission, and every major global human rights organisation.
In its January and March 2024 provisional measures, the ICJ found a plausible risk of genocide and ordered Israel to prevent genocidal acts, allow humanitarian access, and preserve evidence of crimes. Kushner has since stated that Israel is flattening Rafah in preparation for development. With thousands of Palestinians still missing beneath the rubble, this constitutes the destruction of potential mass graves and undermines ongoing legal proceedings.
This is not reconstruction. It is the monetisation of atrocity. There are no credible protections for Palestinian land ownership, refugee return, or self-determination. Survivors of genocide will not be able to purchase luxury housing marketed to international investors. These developments are designed to replace Palestinians, not house them.
Under international law, third states are prohibited from recognising, aiding, or assisting serious breaches, including genocide, unlawful occupation, and the acquisition of territory by force. Continued political, economic, or military support for Israel—or participation in redevelopment schemes arising from these crimes—risks legal complicity.
Statements of concern are no longer sufficient. The ICJ has made clear that the risk is grave and ongoing. I urge you to publicly reject the “New Gaza” plan and support concrete measures, including arms embargoes and targeted sanctions on Israel, to enforce international law and end the illegal occupation.
History will judge who acted and who enabled atrocity through silence.
